The O.Berk Company Academic Scholarship (the Scholarship) is awarded bi-annually to eligible students enrolled in an accredited community college or 4-year college/university. The purpose of the Scholarship is to provide financial assistance to a student with an interest in pursuing continuing education in any field.
THE SCHOLARSHIP AWARD
The O.Berk Company Academic Scholarship Foundation, Inc. awards up to four tuition Scholarships each year:
- Two $1,000 one-time awards for accredited community college or 4-year college/university for the Fall Awards and,
- Two $1,000 one-time awards for accredited community college or 4-year college/university for the Spring Awards
Students who meet the following criteria are eligible to be considered for the Scholarship. The candidate:
- Has a minimum cumulative grade point average of 2.75 and has graduated from a US high school or has obtained a US GED at the time of application (attach official transcript or record from the US high school); OR is enrolled full time at an accredited community college or 4-year college/university as a student at the undergraduate level with a minimum cumulative grade point average of 2.5 at the time of application (attach official transcript or record from the institution)

Application materials must be received by midnight (E.S.T.) on May 15th (for Fall Award) or midnight (E.S.T.) on October 15th (for Spring Award) in order to be considered. Incomplete applications will be disregarded and will not be considered for the Scholarship. The following materials should be submitted:
- Completed application form
- A typed essay (no more than one page double spaced) addressing one of the following topics:
- Describe an accomplishment you have been recognized for and its influence on you.
- Who has been most influential in your life and why?
- What are your career aspirations and why?
- Describe a business concept that you have found to be inspiring and describe why?
- One letter of reference or recommendation from a teacher, coach, or other adult who is not an immediate relative.
- Written confirmation of enrollment for the upcoming semester at an accredited community college or 4-year college/university.
- The essay must be the applicant’s original work that (a) has been created by herself/himself and (b) does not infringe upon the intellectual property rights of any other individual or entity.
Winning applicants will be selected by an independent committee of academic professors based on application materials provided. The decision of the judges is final. Notification of the winning applicants will be provided by June 30th (for Fall Awards) or December 5th (for Spring Awards). Scholarships will be paid directly to the winning applicant’s accredited community college or 4-year college/university in accordance with the college’s/university’s scholarship guidelines. Each winning applicant will be required to provide his/her social security number.

Each eligible applicant is allowed to submit one application per award period. If multiple applications are submitted for the same award period, all applications by the applicant will be disqualified. If any material contained in an application is inaccurate or misleading, such applicant will be disqualified from a potential award. If an applicant’s essay is not an original, non-infringing work of such applicant, then the application will be disqualified from a potential award.

If the applicant is a minor, the application must include parental or legal guardian consent.
By submitting an application, each applicant fully and unconditionally agrees to be bound by and accepts the terms contained on this website and in the application and the decisions of the Scholarship Review Committee (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winners, and the awarding of the Scholarship prize), which are final and binding in all respects.
PARTICIPANT TERMS AND DISCLAIMERS
All written submissions become the property of The O.Berk Company Academic Scholarship Foundation, Inc. and may be reproduced, published, used, and/or displayed on O.Berk Company, L.L.C.’s website, blog, social media accounts, email materials, printed promotional materials, or elsewhere as determined by The O.Berk Company Academic Scholarship Foundation, Inc. in its sole discretion. Such publication may include your submission, as well as any of the information contained in your application, including, without limitation, your name and the community college or 4-year college/university you are attending or will attend. By submitting an application, you irrevocably grant to The O.Berk Company Academic Scholarship Foundation, Inc. and O.Berk Company, L.L.C. a non-exclusive assignment of all right, title, and interest (including copyrights) in and to your submission. You likewise grant a royalty-free, perpetual, and non-exclusive license to exercise all copyrights in your submission. In granting those rights, you knowingly, voluntarily and irrevocably waive all rights in your submission arising under Section 106A of the U.S. Copyright Act (17 U.S.C. § 106A) and all “moral rights” in your submission arising under any applicable law of any jurisdiction. You acknowledge and agree that the right to submit an application and to be considered for a scholarship award if eligible, constitutes good and sufficient consideration for the agreements, grants, waivers and other undertakings set forth in this paragraph. You unconditionally and irrevocably waive and disclaim all rights and claims to compensation for the exercise of all rights, licenses and privileges relating to or arising from your submission.
Full time employees of O.Berk Company, L.L.C. and their families who satisfy the eligibility criteria noted above may submit an application for the Scholarship after at least 6 months of consecutive employment.
The O.Berk Company Academic Scholarship Foundation, Inc. reserves the right, in its sole discretion, to terminate, modify or suspend the Scholarship program if, in The O.Berk Company Academic Scholarship Foundation, Inc.’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Scholarship program, of if viruses, bugs, unauthorized intervention, fraud, technical difficulties or failures or any other factor beyond The O.Berk Company Academic Scholarship Foundation, Inc.’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Scholarship program. In such event, The O.Berk Company Academic Scholarship Foundation, Inc., reserves the right (but does not have the obligation) in its sole discretion to award prizes at random from among eligible, non-suspect entries received up to the time of suspected impairment. The O.Berk Company Academic Scholarship Foundation, Inc., reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process of the operation of the Scholarship program or to be acting in violation of the rules. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of this Scholarship program may constitute a violation of criminal and civil laws, and, should such an attempt be made, The O.Berk Company Academic Scholarship Foundation, Inc., reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. The O.Berk Company Academic Scholarship Foundation, Inc.’s failure to enforce any term of these rules shall not constitute a waiver of that provision or any other provision of these rules.
RELEASE. By entering, each entrant forever and irrevocably releases and holds harmless (a) all persons and entities involved in the process of receiving, reviewing, and evaluating applications (including, without limitation, members of the scholarship review board), and awarding the Scholarship, and (b) O.Berk Company, L.L.C. and The O.Berk Company Academic Scholarship Foundation, Inc., and their parents, subsidiaries and affiliates, and all of their respective owners, employees, officers, directors, agents, representatives, attorneys, and accountants, from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from your participation and/or entry in the Scholarship program and/or any award, receipt or use of any prize awarded in the Scholarship program.
LIMITATIONS OF LIABILITY. The O.Berk Company Academic Scholarship Foundation, Inc. and O.Berk Company, L.L.C., are not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, altered, incomplete, or misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Scholarship program; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Scholarship program or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Scholarship program, or from viewing, playing or downloading any material from The O.Berk Company Academic Scholarship Foundation, Inc.’s website(s), regardless of whether the material was prepared by The O.Berk Company Academic Scholarship Foundation, Inc. or a third party, and regardless of whether the material is connected to The O.Berk Company Academic Scholarship Foundation, Inc.’s or to O.Berk Company, LLC’s websites by a hypertext link.
DISPUTES. You agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Scholarship program, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in Superior Court of New Jersey, Union County, or the Federal District Court for the District of New Jersey (Newark Vicinage); you agree to submit to the sole and exclusive personal jurisdiction to said courts in the State of New Jersey for any such dispute and irrevocably waive any and all rights, to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Scholarship program but in no event attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for and you hereby waives all rights to claim direct, indirect, incidental, consequential, special or punitive damages, including, but not limited to, any damages resulting from any failure on the part of any of the aforementioned entities or individuals to perform hereunder. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of applicants or The O.Berk Company Academic Scholarship Foundation, Inc. or any entity or person associated with The O.Berk Company Academic Scholarship Foundation, Inc. in connection with the Scholarship program shall be governed by, and construed in accordance with, the laws of the State of New Jersey without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New Jersey, the United States, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.
CANCELLATION. If for any reason beyond the control of The O.Berk Company Academic Scholarship Foundation, Inc. the Scholarship program is unable to be held, or for any cause affecting the Scholarship program’s operability, fairness, integrity, or accuracy, The O.Berk Company Academic Scholarship Foundation, Inc. reserves the right to modify, suspend, or cancel the Scholarship program without notice.
